Listing agents should disclose nuisance problems

This is to inform you of an ongoing problem that we are experiencing on Bear Loop with the homes being rented by Cool Cabins. On August 1, 2006 two Board Officers and myself, a resident, met with Tina McCrudden and Melisa Cabrera at their office because there was a particularly bad event the weekend of July 28th through 30th. There were two homes rented with overages of people, with too many cars. At one home the renters were causing disturbance of the peace and the Sheriff had to be called on Friday night to quiet them down. They stayed until being evicted Sunday morning by Cool Cabins.
This past weekend, August 18th through the 20th, again two homes were rented. One home had a tour bus arrive (yes and actual tour bus) and over 50 people unloaded into the house, the other home had over 20 people staying. Cool Cabins was called immediately regarding the house with the bus.
This morning a Board Officer, Dave Lorenzen, called to set up another meeting with Tina although she said she was too busy, she did explain that, "they have no control over how many people actually show up to the home and they can't be everywhere to check on cabins." She did tell Mr. Lorenzen that they will continue to send out staff to evict if there is a call from the neighbors that there are too many people. This leaves the policing of the matter in the hands of the residents.
If this continues it may turn into a legal matter, because the property owners are concerned with the value of their properties, the ongoing noise and nuisance. We have already had one recent buyer state that if they knew of this rental problem they would not have bought on Bear Loop (their property backs up to a rental). The residents on Bear Loop bought here to live on a quiet and beautiful street.
The purpose of this letter is to inform you to disclose this to any interested buyer that there is an ongoing problem of nuisance, disturbance of peace and at any given time there may be up to 50 people with their vehicles staying next to them in their new home.

Dave and I met with the owner of the home that had the tour bus arrive with over 50 people. He had no Idea that his house was being rented to so many people. I'm sure this happens all over the valley and if the owner approves 10 but actually 20 arrive, he really isn't getting his just income for usage. This is an old trick in the rental market, so consider this.
This owner was bewildered at the damage to his home and property until he was made aware of the situation. These absentee landlords aren't doing Big Bear any favors.

It's more than just the tax bill shocker (actually the Country of SB just mailed out tax bills). I have a brother who is a mortgage broker. He is getting a lot of calls right now where people obtained those 0 down, interest only adjustables in th epast two years to qualify for a house twice as expensive as they could afford. In other words, these adjustables are adjusting. THat measely $2,200 payment is now $4,700 and going up more. Sad thing is these people have no equity to refinance.
BB RE is not immune from these problems as people think. True, as a resort town, we tend to lag about 6 months behind DTH. But, this town is starting to see things change drastically as well. It's true that 2/3 or more of our housing stock up here is second homeowners (I think it is actually more than that as there are many individuals who own a home up here and rent DTH that are counted as primary homeowners as they own nothing else).
A lot of these people who bought second homes over the past 2-3 years bought thinking they could rent out their vacation home and help pay for the mortgage. Some were even told that they could have their mortgage paid for by renting it out. Unfortunately, there are way too many of them out there. When Cool Cabins has over 600 of them alone, you know there are way too many. By the way, a judge has called me "sophisticated" (16 cabins) and my neighbors Cool Cabins are not with 600+....
But, I actually think that if this problem gets corrected (say, by ballot or something ), Big Bear will be in for prosperous times with real estate. Here's why......
Prior to the boom of the past 3-4 years where homes up here were being gobbled up by anyone and everyone, regardless of financial stableness (if you could sign your name, you qualified...), we were seeing a great deal of many individuals relocating themselves up here to either telecommute or work out of their homes. That seemed to die down when the vacation rental roundup frenzy started. In my opinion, when this whole vacation rental frenzy runs its course, sellers will be forced to fix up their houses to attract these more desired and stable relocaters. In turn, home prices up here should stabilize or even inch upwards. Before you think I am smoking crack or something, this is supported by several scholarly studies including one from a professor out of U of Fla at Gainesville (DR James _______?) who revealed that home prices in Key West skyrocketed once vacation rentals were controlled by ordinances.
A lot of these vacation rentals were being sold as is because of the high demand. For those of you (including myself) that watched HGTV's show a few months ago saw the three dumps that Chuck Hurd showed the clients. In one of the three the weeds were like six feet high right next to the house. Do you really think some professional whlo is thinking of relocating to the mountains would consider moving here seeing that? NO!!! Guess what? THey are moving to Lake Arrowhead in groves though. Isn't this the same place that was almost burned down? They'd rather have almost burned than slumville.
